請教國語讀音與公民

想請問一題公民題目:

憲法是由國民大會所制定的嗎?
但國大不是在94年第7次修憲時就廢掉了嗎?
所以應該是由立法院制定的吧?

因為書本上寫說我國的憲法是由制憲國民大會制定
因此感到非常的疑惑,請了解的人告訴我,謝謝!!

另外一題國文題目:

「徇」私舞弊:ㄒㄩㄣˋ
「徇」私:ㄒㄩㄣˊ

此兩字讀音對嗎?兩者意義有何不同?
