急~查獲安非他命累犯

知識問題|

朋友因之前有被勒戒過(也不知道有沒有前科)離至今差不多5年上下~那天警方拿搜索票跟拘捕令(就是法院傳到案~但是有寫到哪一天後即無效)~朋友看警察來後就跑了(雙方的距離不到兩個腳步~但警方沒認出他是當事人~警方走去問別人~當事人就趁機走了)~然後警方就發現一個包包就咬定是當事人的包包就翻開來(警方並沒有請其他人注意看)就在裡面拿出一袋安非他命跟兩包殘渣袋~~~~
因為現在也連絡不到朋友~~~
問這樣會是被栽贓嗎?會有什麼刑責呢?
離上次5年內跟5年外刑責有差別嗎?
如果自行投案的時間是5年內跟5年外會有差嗎?
這樣會被說是拒捕嗎?
