填了離職單不願離職 又要資遣費

有位員工101年10月底申請離職也依公司規定一個月前提出.11月初開始就診疑是手挽不適.開始陸陸續續請病假,然後又到鄉下的醫院度假. 然而就開出診斷書申請職業病.老保局來電說申請離職填寫11月底但發病是11月初不得解雇離職.職業病申請書也多次申請多次駁回, 看診醫生說診斷都開這樣ㄌ沒理由沒過,迄而不捨的醫生最後總算如願過ㄌ.就這樣10個月沒回來上班過.前些日子還至縣政府申請資遣費, 協調後資遣費被駁回最後還是付10幾萬和解.最近又提資遣費的問題.

大家都說勞保局只站在勞方,資方對勞方無理的要求就該予取予求ㄇ
雖然想訴諸法律,但還是懇求各位給點意見
