前母兄長不准母親(後母)入祖先牌位

我的生母為父親(已過世多年)續絃所娶, 母親去年過世如今已屆對年, 該是入祖先牌位(合爐)的時候, 但前母兄長阻撓, 威脅不得合爐, 因祖先牌位在兄長家裡, 我也無法擅闖, 所以不知道到時候該怎麼辦?
另外, 他說合爐的條件, 除非是 "馬上" 分爐, 因為他不想祭祀我的母親~~, 想問的是, 難道分爐後, 他所祭拜的祖先牌位, 就不包括我的母親了嗎? 難道說 "分爐" , 可以指定要把那一位祖先分出去?
