中華民國法律是指中華民國的法律，目前有效施行於台澎金馬（亦即中華民國自由地區）。其法律架構主要採行大陸法系制度，民事訴訟、刑事訴訟、選舉訴訟歸一般法院，而行政訴訟歸行政法院。至於軍人，則受軍法規範，由軍事法院負責。

依《軍事審判法》之規定，軍事法院隸屬於國防部，而非司法院。軍事法院分為最高軍事法院、高等軍事法院以及地方軍事法院，除最高軍事法院應設於中央政府所在地外，均由中華民國國防部視部隊任務需要設置。

且需注意的是，最高軍事法院雖然名曰「最高」，但並非表示其為軍事案件的終審機關。關於最高軍事法院所做出的判決，在釋字436號解釋之後，可以依案件性質上訴至普通法院中的高等法院或最高法院。
