不算商品，但仍違反智慧財產權。

目前所有經公告後的智慧產權都需要取得智慧產權擁有者同意後，才能使用。

這跟有沒有商業行為無關。好比說，如果有一個發明已取得專利，而你透過專利局的公告看到了那個發明，自己依樣畫葫蘆做了一個在家自己玩耍，若被人看到了，並且提告，仍然要吃官司的。
