資遺協調不成如後續應如何做

各位大大
請問如果被資遺，也有到市政府那協調但沒有成功，我下步應要如何處理呢？
還有我是屬於符合資遺的要件，但資方卻要用協議離職的方式給我離職金我不同意，而且當初在公司我也沒簽任何的文件。我是不是更有權利要求
還有公司因為是不足5人所以可以不用保勞保，如此的話對我有何方式可以解套？可以要求我應有的權利呢？
如果要走上司法，我應從那下手會比較快也比較有利的。
因為從我被資遺至今己2個月了了，所以不知有沒有所謂的時效性的問題。
調解也有1.5個月的時間了，但都沒有成效，還被資方說，如果我要告，他就陪我玩 ....氣，所以想要快點解決這事
