我的奶奶在昨天撿骨，裡面有遺物黃金戒指3個.耳環一對.玉手環一個

可是，爸爸的妹妹認為還有一條金項鍊，是我們拿走的。可是撿骨師交給我爸爸的明明只有黃金戒指.耳環.玉手環，並沒有金項鍊。

爸爸的妹妹沒有在現場，而且當初說好都要讓我爸爸全程處理撿骨的事情。所以爸爸想說那些金子變現當成撿骨的.買塔位.地理師.看日子的費用，所以東西先暫時放在我們這裡，並沒有變賣！但是她一直強調要告我們侵占，我爸爸有去找撿骨師錄音證實只有戒指3個.耳環一對.玉手環一個，並沒有金項鍊

這樣子撿骨師有罪嗎？

她要告我們侵占，請問她告的侵占罪會成立嗎？
