關於領養手續問題(希望懂法律的)

我大姑是未婚的單親媽媽，她有個兒子現在9歲，
這小孩的父親從沒見過，所以小孩的父親欄是空白的，
我二伯很想領養這小孩，因我大姑對這兒子不聞不問不照顧，
這小孩一直是我公婆及二伯在照顧，
我大姑的精神狀態不好，有三次自殺記錄又好賭，之前曾要傷害我公婆，
我公婆有申請過保護令，我公婆很希望這小孩能過繼給我二伯，
我二伯單身有正當的工作，請問我二伯要怎麼辦領養手續，
如果我二伯無法領養這小孩，我公婆可以擁有這小孩的監護權嗎？
