我的家人在80年時幫人做保，今天收到法院的扣押命令，經了解後才知道銀行是在98年時向法院聲請支付命令，因為家人收到後都沒有向法院異議，所以支付命令已經確定了，請問：
1、銀行超過15年的請求權後，才向法院聲請的支付命令有效嗎？
2、我們現在再向法院異議時效消滅，拒絕給付有用嗎？
