A:受害人(樓下)
B:定作人(樓上)
C:承攬人(行為人即加害人)

承攬人C，承攬B之水電裝修，於施工中不慎漏水，造成損鄰。
包商有意願修繕，但對損害認定及範圍，雙方認知差距太大。
調解不成，受害人應向B定作人提告? 還是向C承攬人提告?
