事情是這樣的，我父母結婚已經40年了，6年前自從我爸退休後，就經常不住在家裡，（他有賭博習慣）這個月銀行來電通知說，我們住了25年的房子再不繳貸款，就要被法院拍賣，我媽驚覺有異，趕緊問銀行，貸款不是幾年前就繳清了嗎？銀行說又貸了370萬，已經4個月沒有繳款，才會致電通知，我媽當下崩潰了，打電話給我爸，叫他回來看要怎麼處理，結果他絲毫無愧意，還厚顏無恥的叫我媽去籌4萬元，先把貸款繳了再賣房子，這樣還會剩ㄧ些錢，然後這些錢再存到他的戶頭，（他是公務員領18趴）100萬生的利息可以補貼我媽租房的費用，ㄧ個沒有家庭觀念的父親，想的是自己能不能過活，我媽真的心灰意冷，決定跟他離婚。
1.房子是我爸的名字，房子做買賣我媽能拿到ㄧ半的錢嗎？
2.房子是我爸得名字，我媽能自己賣掉嗎？
3.我媽要去法院訴請離婚，我們這些兒女要出庭當證人嗎？
