公寓大廈管理條例是否可以限制住戶使用瓦斯

小弟住在一般住宅大樓內,最近大樓的管委會卻傳出,要在開區分所有權人會議時,提出住戶不可在住家內使用桶裝瓦斯的表決(目前社區內剩下三戶使用瓦斯,社區內總共約60多戶住戶),試圖讓社區內不可使用桶裝瓦斯,只能使用電熱水器或電磁爐,小弟是使用桶裝瓦斯的住戶,且並任何影響其他住戶情形~!!

小弟想瞭解的是:

1.使用桶裝瓦斯是合法使用,且是家用,並非經營餐飲或瓦斯的行業,區分所有權人會議的通過與否,是否可以限制住戶合法的使用瓦斯

2.且就小弟的瞭解,法律和憲法都明確保障人的權利與自由,公寓大廈管理條例的法律位階可以高過其他法律的適用嗎而限制住戶的權益嗎?

3.又或著區分所有權人會議如果通過,小弟是否可透過民法來保障自己的權益呢?
