今讀到 (標的妥當)的違反效果): 負擔行為無效, 因為民法72條, 而處分行為因為是中立的, 不涉及價值判斷, 故非無效.

我的問題:
依據民法758以及761條之處分要件有: 登記(交付) / 讓與合議 / 有處分權.
而老師說: 讓與合議也是個契約.  對上去處分行為是中立的, 不涉價值判斷, 不是有毛盾嗎?  讓與合議也是個契約, 也會有負擔丫.
