有下列情形之一者，為相牽連之案件：
一、一人犯數罪者。
二、數人共犯一罪或數罪者。
三、數人同時在同一處所各別犯罪者。
四、犯與本罪有關係之藏匿人犯、湮滅證據、偽證、贓物各罪者。

誣告是前A案判決不成立時。此A案已告一階段結束。

事後被告, 依前A案被偽證陳述所提控告為由, 又新提起被誣告, 成立B案之訴。
