已註冊商標因遭同業評定，經智財局評定不成立後，是否可以求償？

請教各位大大：

我公司向國外進貨，並取得商標註冊權，也註冊商標成功了。
後同業眼紅，向智財局聲請評定(想搶商標吧)，
評定期間(一年兩個月)公司擔心註冊的商標出問題，
因此全面停賣該商標的所有產品。
後經智財局評定不成立。

請問
1. 評定期間的營業損失可否向對方求償？
　(可舉證該商標產品遭評定前的年營業額及評定後的營業額)

2.對方在評定期間在網路上公開銷售該商標的商品(平行輸入)，我們是否可以對他主張？
