招牌掛在別人的土地上

我想問一下, 我店的招牌, 型狀是這樣 O=
O部份直徑75公分, =部份長約30公分, 固定在我承租的店的牆柱上
最低部份離地面約220公分

店外面是一條現有巷, 屬於旁邊大樓的空地比, 也是開放空間

旁邊大樓總幹事來要求我拆除

我查了建管處, 這個尺寸的招牌不用申報
而且離地面也夠高, 不會有安全問題

請問一下, 我的招牌是否違法? 如果是, 是什麼? 侵占嗎? 那麼小一個一定要拆嗎?

生意已經那麼難做了, 還醬, 唉~~~
